Klarity is an electronic-discovery and digital-forensics platform operated by Octio (Pty) Ltd ("Klarity", "we", "us"), provided to law firms, forensic investigators, and their authorised users in the Republic of South Africa and elsewhere.

These terms form the agreement between Klarity and the subscribing firm (the "Customer"). The person who accepts these terms during firm onboarding warrants that they are authorised to bind the Customer. Individual users invited by the Customer are bound by the acceptable-use provisions (section 6) and the Privacy Policy.

Klarity provides document ingestion, processing, search, review, production, and forensic-analysis tooling on a software-as-a-service basis. Service scope, plans, and any usage limits are as agreed with the Customer in the applicable order or plan.

The Customer retains all rights in the documents, images, and other material it uploads ("Customer Data"). Klarity processes Customer Data solely to provide the service, as the Customer's operator under the Protection of Personal Information Act, 2013 (POPIA). Customer Data is hosted in the AWS Africa (Cape Town) region. The Customer warrants that it has the legal right to upload and process the material it submits, including any lawful-collection requirements applicable to forensic images.

Klarity records custody events and content hashes for ingested material. These records are provided in support of the Customer's evidentiary process; responsibility for the admissibility of evidence remains with the Customer.

Users must not: attempt to access another tenant's data; upload material they have no lawful right to process; probe, scan, or disrupt the service; share account credentials; or use the service to infringe any person's rights. We may suspend accounts that endanger the service or other tenants.

We target commercially reasonable availability and provide support via support@getklarity.co.za. Planned maintenance is announced in advance where practicable.

Either party may terminate as set out in the order. On termination, the Customer may export its data for a reasonable wind-down period, after which Customer Data is deleted.

These terms are governed by the laws of the Republic of South Africa.
